Terms of Service

Welcome to HomeContentsListPro (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the HomeContentsListPro web application, located at https://homecontentslistpro.com, and any related services, features, or content (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Who May Use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.
If you use the Service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
2. Account Registration and Security
- Registration Information
You must provide accurate, current, and complete information when creating an account, and you agree to update it as needed.
- Account Security
You are responsible for maintaining the security of your login credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
- Two-Factor Authentication
We may offer or require two-factor authentication (2FA). If you enable 2FA, you are responsible for maintaining access to your chosen 2FA method.
- Account Restrictions
We reserve the right to suspend or terminate your account if we believe you have violated these Terms, engaged in fraudulent activity, or jeopardized the security of the Service.
3. Subscription Plans and Billing
- Plans and Trials
The Service may be offered through subscription plans, which can include limited-time trials. Plan details, pricing, trial periods, and limits (e.g., the number of properties or items) are described at signup and may be updated over time. We may offer promotional discounts or codes at our discretion.
- Billing
Subscriptions are billed through Stripe, Inc. By subscribing, you authorize us and Stripe to charge your payment method at the frequency stated (e.g., monthly or annually). Subscription fees are non-refundable except where required by law. You are responsible for any taxes associated with your subscription.
- Renewals and Cancellations
Subscriptions automatically renew unless canceled before the renewal date. You can manage your subscription and cancel through the Service or via the Stripe customer portal. Canceling stops future charges but does not automatically provide refunds for past charges.
- Upgrades, Downgrades, and Changes
If you upgrade, downgrade, or change plans, Stripe may prorate charges according to its policies. Some plan changes may affect the number of properties, rooms, or items you can manage. We may offer grace periods before enforcing limits on downgraded accounts.
- Failed Payments
If a payment fails, we may attempt to re-process it and notify you. We reserve the right to suspend or terminate your access if we cannot process payment.
4. Acceptable Use and User Responsibility
You agree not to:
- Use the Service for illegal purposes or in violation of any law or regulation.
- Upload, store, or transmit content that is unlawful, defamatory, abusive, harassing, threatening, or otherwise objectionable.
- Interfere with or disrupt the Service, its servers, or networks.
- Reverse engineer, decompile, or disassemble any portion of the Service.
- Attempt to gain unauthorized access to other accounts or systems.
- Use the Service to send unsolicited communications (spam).
- Share your account with others outside your household or organization unless explicitly permitted.
- Misuse the Service to store or distribute malware, viruses, or harmful code.
We may investigate violations and cooperate with law enforcement if we suspect activity is illegal or harmful.
5. User Content and Data
- Ownership
You retain ownership of the content you upload or create (“User Content”), including inventory records, documents, and photos.
- Permissions
By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and modify the content solely to provide and improve the Service. We do not sell User Content to third parties.
- Backups and Retention
We perform regular backups, but we do not guarantee that content will always be recoverable. You are encouraged to export and back up your data regularly.
- Deletion
You can delete items, rooms, or entire accounts through the Service. Deleted data may remain in backups for up to 30 days before permanent removal. We may retain certain data to comply with legal obligations or resolve disputes.
6. Service Availability and Modifications
- Availability
We strive to keep the Service available but cannot guarantee uninterrupted access. Maintenance, technical issues, or other events may occasionally disrupt service.
- Modifications
We may add, modify, or remove features at any time. If material changes affect your subscription or significantly impact functionality, we will make a reasonable effort to notify you in advance.
- Beta or Preview Features
We may offer experimental or beta features. These may be subject to special terms and may be discontinued at any time without notice.
7. Privacy
Our Privacy Policy explains how we collect, use, and share information about you when you use the Service. By using the Service, you agree to our Privacy Policy.
8. Third-Party Services
The Service integrates with third-party services (e.g., Stripe, analytics providers, email services). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services or how they handle your data.
9. Intellectual Property
- Company IP
The Service, including its software, design, trademarks, and documentation, is owned by HomeContentsListPro or our licensors and is protected by copyright, trademark, and other laws.
- Limited License
We grant you a limited, non-transferable, non-exclusive license to access and use the Service for your internal business or personal purposes in accordance with these Terms.
- Feedback
If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use it in any manner without obligation to you.
10. Disclaimers
- The Service is provided “as is” and “as available”. We make no warranties (express, implied, or statutory) regarding the Service, including its accuracy, reliability, or fitness for a particular purpose.
- We do not guarantee that the Service will be error-free, secure, or available at all times.
- The Service is designed to help organize home inventory information; it does not constitute legal, financial, or insurance advice. You are responsible for ensuring your data meets the requirements of your insurer or jurisdiction.
11. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from or related to your use of the Service.
- Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the amount paid, if any, by you to us in the 12 months preceding the claim.
- These limitations apply even if we have been advised of the possibility of damages and apply regardless of the legal theory.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless HomeContentsListPro, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
13. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, and without notice. You may cancel your account at any time via the Service or by contacting support. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination (e.g., Sections 3, 5(b), 9, 10, 11, 12) will remain in effect.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Nashville, Tennessee, and you consent to the personal jurisdiction of those courts.
If you are located outside the United States, you agree that any dispute between us will be subject to U.S. federal or Tennessee state law as described above.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective Date” above and may notify you via email or an in-app notification. Your continued use of the Service after the updated Terms become effective constitutes your acceptance. If you do not agree, you must stop using the Service.
